1. Acceptance of Terms

By downloading, installing, or using Gym Track: Workout Log (the "App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the App.

2. Description of Service

Gym Track is a workout logging application that allows you to track exercises, sets, reps, and other training data. The App also offers AI-powered coaching, workout generation, and post-workout analysis features.

3. Accounts

You must create an account to use the App. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information when creating your account.

4. Subscriptions and Payments

Gym Track offers a free tier with limited features and a Pro subscription that unlocks additional features including unlimited AI coaching, workout generation, post-workout analysis, volume tracking, and data export.

• Subscriptions are billed on a monthly or annual basis through Apple's App Store.
• Payment will be charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan.
• You can manage and cancel your subscriptions by going to your Account Settings on the App Store after purchase.
• No refunds will be provided for any unused portion of a subscription period, except as required by applicable law.

5. Free Trial

If offered, a free trial period allows you to use Pro features at no charge. If you do not cancel before the trial ends, your subscription will begin and you will be charged at the applicable rate.

6. AI Features Disclaimer

The AI Coach, workout generation, and post-workout analysis features are provided for informational purposes only. They do not constitute medical, fitness, or health advice. Always consult a qualified healthcare or fitness professional before starting any exercise program or making changes to your training. We are not liable for any injury or harm resulting from reliance on AI-generated content.

7. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to the App or its systems
• Interfere with or disrupt the App or its servers
• Reverse engineer, decompile, or disassemble any part of the App
• Use the AI features to generate harmful, abusive, or inappropriate content

8. Intellectual Property

The App and its content, features, and functionality are owned by Viking Tech and are protected by copyright, trademark, and other intellectual property laws. You retain ownership of the workout data you create within the App.

9. Limitation of Liability

To the maximum extent permitted by law, Viking Tech shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, profits, or goodwill, arising out of or in connection with your use of the App. Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.

10. Termination

We may terminate or suspend your account at any time if you violate these Terms. Upon termination, your right to use the App will cease immediately. You may delete your account at any time through the App settings.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated terms in the App or on our website. Your continued use of the App after changes are posted constitutes acceptance of the updated terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law provisions.
